1. APPLICATION OF THE GENERAL TERMS AND CONDITIONS – ENFORCEABILITY

These general terms and conditions govern the contractual relationship between Les Tanukis and website visitors (whether registered or not, and whether a user of paying services or not), and both parties agree to them unreservedly. Hereinafter, the term "User" refers to registered users and "Visitor" to unregistered users.

These General Terms and Conditions of Use apply to all actions performed on the Datingsim website (hereinafter "the Site"). By visiting the Site, you accept the General Terms and Conditions of Use. If not, you should exit the Site immediately. By registering on the Site, you become a User of the products and services that are provided free of charge or in return for payment. To this end, a personal “user account” is opened for you, which you can access using identifiers (pseudonym and passwords) that you define yourself. If you disagree with any of the provisions in this document concerning Users please do not register. The User declares that (s)he has reached the legal age of majority as defined by the laws of his or her country of residence or that (s)he has the legal authority to agree to be bound by these terms and conditions. If you are in any doubt, make sure that your parents or legal guardian(s) are present when you accept this contract or when you purchase Credits (the virtual money used on the Site). The aim of the Site is to build up a community of players around the game products on offer. Due to this social interaction aspect, we strongly recommend that parents do not allow their children to give their real name, address or telephone number without their permission. In some countries, no information can be submitted to a website by children who do not produce proof of minimum age, unless they obtain prior written consent or verifiable authorization from a parent or guardian. Please do not proceed with registration if this is the case in your country and if this procedure is not proposed to you automatically by the Site. The content and services of the Site evolve, and are therefore subject to constant change. Likewise, our Privacy Policy, and the General Terms and Conditions of Use may change, to adapt to these developments. We can send you the new version of the contract document by e-mail, letter or any other means. If you do not accept this new version you are free to unregister from the Site or to no longer log in.

2. PAYING SERVICES

Credits
All payments within the Site are made using a virtual currency called “Credits”. This currency is used to pay for all the paying services offered by the Site. Credits can be purchased by various means, at the User's discretion. Credits are purchased through the micro-payment system operated by the company Rentabiliweb (http://www.rentabiliweb.com/).


Credits CREDITED TO USER ACCOUNTS WILL NOT BE REIMBURSED IN REAL MONEY UNDER ANY CIRCUMSTANCES, INCLUDING IF YOUR MEMBERSHIP IS TERMINATED EARLY AS A RESULT OF THE MISUSE OF THE SERVICE BY THE USER.

Les Tanukis may from time to time distribute free Credits as a gesture of goodwill; this shall not be interpreted as creating any kind of obligation for the future.



Nature of the paying services:

The Site's paying services consist of games. The sum paid by the User corresponds to a right of access to the Site to view the game ordered, for a period for a specific range of time or number of tries (also called « lives »). Once the payment has been made, the User's account is granted access to the game via the Site. The right acquired by the User is strictly limited to the right of access to the game over the Internet. The paying services require permanent access to the Internet. Les Tanukis shall in no way be held liable if the User is unable to access the service due to the User's difficulty in connecting to the Internet. No physical copy of the game corresponding to the service will be sent to the User unless the service is terminated earlier than the planned contract date. In such a case, the User will have the right to demand access to the service by some other means (such as a version to be installed on a compatible computer).

Content of paying services:

The content of the paying services is suitable for all ages. However, you will be notified, if necessary, before confirming your order, of the minimum recommended age for access to the service and of any content that could upset younger users. The paying services are accessed as follows:

1/ Choice of the paying service on the Site
2/ Registration with the Site, if not already effected
3/ Purchase of any required Credits
4/ Confirmation of the service access request, the price to be paid in Credits and the acceptation of the terms and conditions that apply to the Site and to the service
5/ Payment using the Credits in the user account
6/ E-mail confirmation of the fulfilment of the access request
7/ The service is now immediately available.

Acceptance of the contractual conditions:

By clicking the checkbox you confirm that you have been made aware of the General Terms and Conditions of Use of the Site; by proceeding with payment, you accept the said terms and conditions and any other documents specific to the service without reserve.
The Site's paying services may require you to accept a contractual document specific to a particular service, in addition to the general terms and conditions.
In the case of paying services, the contractual conditions accepted by the User at the moment of payment shall apply for the duration of the rights acquired in the service purchased.

4. CUSTOMER LIABILITY

The information supplied by the User when signing up for the service engages the User's liability: any error is the sole liability of the User. The User has sole responsibility for the security of the identifiers and passwords used for access to the user account. If these identifiers are lost, a retrieval procedure is provided on the login page.
Multi-player sessions / postings by the User / communication with other members.

By using the free or paying services of the Site, the User implicitly accepts the following. Failure to comply with these obligations exposes Users to temporary or definitive suspension of access to the site, accompanied, in the latter case, by the deletion of the account and of all the Credits held in it. These sanctions will be preceded by several e-mail warnings. When Users make use of the communication channels provided by the Site in its free or paying services, they are prohibited from:

1. sending messages, information, data, text, computer files, graphics or other elements that are illicit, counterfeit, harmful, threatening, insulting, bullying, libelous, crude, violent, obscene, racist, disrespectful of people's private life, commercial in nature, inciting hatred, or in any other way objectionable;

2. more generally, infringing public order and decency, notably by excusing crimes against humanity, stirring up racial hatred, disseminating child pornography, etc;

3. pretending to be somebody else or to represent another organization than one's own, including, but not limited to, pretending to be a webmaster, and supplying a false identity or misrepresenting one's links to a given person or organization.

Les Tanukis will take all reasonable and technically feasible steps to avoid any infringement of the User's rights. However, Les Tanukis is under no general obligation to monitor content posted on the Site by users, whether or not the content is in principle moderated. Les Tanukis is responsible only for the content that it publishes itself. If Users come across content that they find shocking, or are victims of direct personal attacks, they must inform Les Tanukis as soon as possible. Les Tanukis may take action against any misuse of these procedures, if it is done systematically and clearly without good reason, with the sole purpose of hurting other users.

Users under the legal age of majority must be regularly supervised by their parents or legal guardians in order to verify the Site browsing and playing experience.

5. ARCHIVES

All Credits transactions and all e-mails sent to the User to confirm orders for paying services are automatically saved on the computer systems that host the Site, which is managed and administered by Les Tanukis, whose responsibility it is to implement the electronic transaction process.
Users are invited to keep their own copy of the said confirmation e-mails on any appropriate durable medium and/or to print them out.

6. COOLING-OFF PERIOD

Requests for access to a paying service and the payment thereof are irrevocable once they have been validated electronically by the customer (the “I agree to spend my Credits” button), and acknowledged by an e-mail from Les Tanukis.

The seven-day cooling-off period does not apply, in accordance with the exception provided for in Article L 121-20-2 1°of the French Consumer Code. The reason being that THE USER IS SPECIFICALLY INFORMED THAT THE SERVICE IS MADE AVAILABLE AS SOON AS CONFIRMATION HAS BEEN RECEIVED BY E-MAIL, NAMELY AS SOON AS POSSIBLE AFTER PAYMENT IN Credits.

Likewise, under Article L 121-20-2 4°of the French Consumer Code, the cooling-off period is not applicable when the service provided involves the “[…] supply of audio or video recordings or of software programs, once they have been unwrapped by the consumer […]”

Consequently, in the event of disagreement over the validity of a service request, you can e-mail your complaint, with supporting evidence, to the following address: .

Les Tanukis will decide, after checking the facts of the case, whether to annul the service access contract and reimburse any sums paid for the service (minus expenses incurred by the reimbursement transaction). NOTE: ANY CANCELLATION OR REIMBURSEMENT REQUEST MADE AFTER THE FIRST CONNECTION TO THE PAYING SERVICE IN QUESTION WILL BE AUTOMATICALLY REJECTED.

7. PRODUCTS AND SERVICES

The products and services provided comply with prevailing French and European laws.

8. PRICES

The prices of the products and services on the Site are visible when the Site is viewed. They are expressed in Credits. They apply throughout the period that they are displayed on the Site .

9. LIABILITY

Les Tanukis provides its products and services in accordance with professional standards, with the aim of offering maximum satisfaction to the customer. Les Tanukis is bound by an obligation of means, not results.
If Les Tanukis were to be held liable, directly or indirectly under the terms of this contract, the amount of any damages that the company may be ordered to pay shall be expressly limited to the price paid by the User for the products and services at the center of the dispute.
Users shall, in any event, take all reasonable steps to diminish the damage incurred.

10. INTELLECTUAL PROPERTY

The general structure of the Site, and all the graphic and audio elements that it comprises, contain works that are protected as such by intellectual property laws (in particular copyright laws and laws protecting designs, models and trademarks), and by international treaties.
The Site structure, published texts, distinctive signs, data and original elements may not under any circumstances be modified, copied, displayed, presented in public, distributed or used for any purpose without express prior authorization from Les Tanukis. Such elements include, but are not limited to, the text, software, photos, video, images and graphics, music and sound.
Any other use which is not expressly authorized is strictly prohibited without the prior written consent of Les Tanukis.
Access to one of the Site's paying services confers no additional intellectual property rights on the customer.
In the case of downloadable content deliberately made available to the Site's Users and Visitors by Les Tanukis (wallpapers, widgets, etc…), you are granted authorization to copy the material for personal use only, and are given no property rights over the work. You are strictly prohibited from modifying this element or deleting any wording whether it refers to an author, a trademark, an explanatory note or a copyright statement.

12. VOID CLAUSES

The section headers used in this document are provided for practical guidance only and shall not be used to construe the terms and conditions herein. If any of the clauses of this contract is deemed to be null and void, and, for any reason, non-applicable, then that clause shall be excluded from this contract, but it shall not affect the validity or application of the remaining clauses.

13. APPLICABLE LAW

These General Terms and Conditions of Use and any disputes or objections arising therefrom are subject to French law. All of the clauses herein shall be construed using French law by the competent law courts of Lyon, France, notwithstanding the existence of more than one defender or the introduction of third parties. Users who choose to access the Site from other countries and to use its services do so at their own initiative and must comply with local laws, where applicable.
